Terms of Service - GetDucked

1. Acceptance of Terms

By downloading, installing, or using the GetDucked mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

GetDucked is a mobile application that allows users to track and share rubber duck placements on vehicles as part of the vehicle community tradition. The App provides features including:

Recording and tracking duck placements and discoveries
Viewing nearby duck activity on a map
Connecting with other duck enthusiasts
Sharing photos and experiences
Earning achievements and badges

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Notify us immediately of any unauthorized use
Be responsible for all activities under your account

You must be at least 13 years old to create an account and use the App.

4. Acceptable Use

You agree NOT to:

Use the App for any illegal purpose
Harass, abuse, or harm other users
Post offensive, inappropriate, or harmful content
Impersonate any person or entity
Interfere with or disrupt the App or servers
Attempt to gain unauthorized access to any part of the App
Use the App to spam or send unsolicited messages
Collect user information without consent
Place ducks on vehicles without respecting private property
Use the App while driving or operating a vehicle

5. User Content

You retain ownership of content you submit to the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App.

You are responsible for ensuring you have the right to share any content you upload, including photos of vehicles that may include license plates or other identifying information.

6. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by GetDucked and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The App will be uninterrupted or error-free
Defects will be corrected
The App is free of viruses or harmful components
The results from using the App will meet your expectations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETDUCKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL.

10. Indemnification

You agree to indemnify and hold harmless GetDucked and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App settings.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GetDucked operates, without regard to conflict of law principles.
